Patent Litigation in Las Vegas - Mar. 2007

Speakers for Patent Litigation on March 2, 2007 at the Bellagio in Las Vegas

The Patent Litigation CLE is being held on March 2, 2007 at the Bellagio hotel and casino in Las Vegas. The speakers include Sid Leach, a partner with Snell & Wilmer, Mark A. Miller, an attorney with Holland & Hart, Ryan A. Heck, Ph.D., an attorney with Klarquist Sparkman, Robert S. Rapp, a shareholder with Madson & Austin, Stephen M. Nipper, a shareholder with Dykas, Shaver & Nipper and author of The Invent Blog that focuses on intellectual property issues, and Frederick N. Samuels, a shareholder with Cahn & Samuels, LLP.

Sid Leach is a partner in the law firm of Snell & Wilmer and has more than 28 years of experience in litigating patent infringement actions. Recently, he served as lead counsel for Hypercom Corporation in the multidistrict patent infringement litigation and ITC investigation brought by Verve LLC. That litigation resulted in a judgment against Verve’s lawyers for abuse of process and malicious prosecution based upon patent infringement actions that were filed without an adequate pre-filing investigation.

Sid Leach has successfully litigated patent infringement cases, proceedings before the International Trade Commission, and interference proceedings before the Patent and Trademark Office. He has handled a number of trade secret cases involving computer software and other technology. He has experience in preliminary injunction proceedings and prosecuting appeals to the Federal Circuit. He has represented clients in trademark infringement cases and trademark opposition proceedings before the Patent and Trademark Office. He has appeared in courts across the nation in cases involving IP litigation, including Arizona, Texas, California, Pennsylvania, New York, New Jersey, Michigan, Ohio, Florida, Oklahoma, Louisiana, Virginia, Illinois, Colorado, Kansas, Nevada, Maryland, Minnesota, Oregon, New Hampshire, and Washington, D.C.

Mr. Leach was selected for inclusion in the 2007 edition of The Best Lawyers In America in the specialty of Intellectual Property Law. Mr. Leach received his J.D. degree from the University of Virginia Law School in 1978, and a B.S. in Electrical Engineering from the University of Alabama in 1975. He is admitted to practice in Arizona and Texas, and registered to practice before the United States Patent and Trademark Office.

Mark A. Miller is an attorney with Holland & Hart. Mr. Miller earned a B.S. degree in Civil Engineering from the University of Utah. After receiving his undergraduate degree, Mr. Miller worked as a design engineer on the 17-mile reconstruction of I-15 in Salt Lake City, Utah.

Mr. Miller attended law school at Brigham Young University and earned his J.D. degree, cum laude, in 2002. Following law school, Mr. Miller worked as a law clerk to Chief Judge Dee Benson for the U.S. District Court for the District of Utah. Thereafter, Mr. Miller served as a law clerk to Judge Randall Rader for the U.S. Court of Appeals for the Federal Circuit. Mr. Miller joined Holland & Hart in 2004 following his clerkships. As a registered patent attorney, Mr. Miller's practice focuses on patents, trademarks, and copyrights, with an emphasis on patent litigation and appeals to the Federal Circuit.

Ryan A. Heck, Ph.D. is an attorney with Klarquist Sparkman. Dr. Heck's practice involves all aspects of intellectual property law, including preparation and prosecution of U.S. and foreign patent applications, preparation and prosecution of U.S. trademark applications, litigation, licensing, and providing opinions regarding patentability, validity, and infringement. Although he focuses on the chemical and mechanical arts, Dr. Heck has experience in a wide range of fields. Representative technologies that Dr. Heck has experience in include games of chance, pharmaceutical compositions, genetically modified plants, bioinformatics, sheetrock construction and coatings, oil drilling processes and apparatus, desalination systems, power distribution and monitoring devices, software systems, and synthetic fibers.

Dr. Heck is admitted to practice in the states of Nevada and Texas and is also registered before the U.S. Patent and Trademark Office. His court admissions include the United States District Court for Nevada and the United States District Court for Southern District of Texas.

Robert S. Rapp is a registered patent attorney and shareholder with the firm of Madson & Austin. Robert is a member of the California and Utah State Bars and is admitted to practice before the United States Patent and Trademark Office. His practice focuses primarily on high-tech prosecution and on litigation. Recent significant victories in litigation include a summary judgment that an asserted trademark was generic in the United States District Court for the District of Oregon and a summary judgment of non-infringement of three utility patents in United States District Court for the District of Utah.

Stephen M. Nipper is a partner with the law firm of Dykas, Shaver & Nipper (www.dykaslaw.com) in Boise, Idaho. Mr. Nipper received his Bachelor of Science Degree from Truman State University in Kirksville, Missouri, and his Juris Doctor from Southern Illinois University School of Law.

Mr. Nipper’s practice covers a broad spectrum of intellectual property work, from prosecution to litigation. A significant portion of his work is handling US patent and trademark cases for foreign law firms and corporations. His main experience is in agriculture, the biological and chemical sciences, and mechanical arts.

Mr. Nipper is the author of The Invent Blog, the oldest “patent” law blog which is now in its fourth year. The Invent Blog has a patent law blog covering news and information relevant to patent attorneys who serve independent inventors and small businesses. Mr. Nipper contributes to several other projects, including: FedCirc.us www.fedcirc.us (covering Federal Circuit decisions) and Rethink(IP) (www.rethinkip.com).

Frederick N. Samuels has been involved in the field of intellectual property since 1986. Mr. Samuels began his career as a Patent Examiner in the United States Patent and Trademark Office and has been in private practice since 1990. Mr. Samuels has extensive experience in all aspects of intellectual property, including litigation, administrative proceedings, patent and trademark procurement, technology transfer and licensing. Mr. Samuels focuses his broad experience to provide clients with strategic, business-orientated counseling in the acquisition, management and exploitation of their intellectual property. In this regard, Mr. Samuels has devised and implemented intellectual business strategies for clients of all sizes and at all stages of development.

Mr. Samuels has prosecuted numerous patents in a vast array of technologies and has successfully handled patent appeals to the Board of Patent Appeals and Interferences. Mr. Samuels also regularly prosecutes trademarks and copyrights for his clients both foreign and domestic. In addition to ex parte matters before the U.S. Patent and Trademark Office, Mr. Samuels handles opposition and cancellation proceedings for his clients.
